The following Terms and Conditions, the AskMyMob Privacy Policy and the AskMyMob Community Rules, all incorporated herein by this reference, govern your access to and use of the services provided at wwws.AskMyMob.com (the "Site") and its interactive platforms available via the internet and mobile devices (the "Services").

PLEASE READ THE TERMS AND CONDITIONS CAREFULLY BEFORE ACCESSING OR USING THE SITE OR SERVICES. YOU ACKNOWLEDGE AND AGREE THAT, BY CLICKING THE "JOIN" BUTTON ON THE SIGN-UP PAGE DURING YOUR ACCOUNT CREATION PROCESS, OR BY SUBMITTING A VOTE, OR BY ACCESSING ANY CONTENT ON THE SITE OR THROUGH THE SERVICES, YOU ARE INDICATING THAT YOU HAVE READ, UNDERSTOOD AND AGREED TO BE BOUND BY THESE TERMS AND CONDITIONS. IF YOU DO NOT AGREE TO THESE TERMS AND CONDITIONS, THEN YOU HAVE NO RIGHT TO ACCESS OR USE THE SITE, SERVICES OR ASKMYMOB CONTENT.

Copyright

All copyright, trade marks and all other intellectual property rights in the Site, Services and Content (including without limitation for the Site and Service's design, text, graphics and all software and source codes connected with the Site and Services, excluding user-generated content) are owned by or licensed to AskMyMob or otherwise used by AskMyMob as permitted by law.

In accessing the Site you agree that you will access the content solely for your personal, non-commercial use. None of the content may be downloaded, copied, reproduced, transmitted, stored, sold or distributed without the prior written consent of the copyright holder. This excludes the downloading, copying and/or printing of pages of the Site for personal, non-commercial home use only.

User-generated Content

The Site and Services provide you with the ability to add, create, upload, submit, distribute or post ("Submitting" or "Submission") content, written forum comments, pictures, data, text, or other information to the Site (collectively, the "User-generated Content"). By Submitting User-generated Content to the Site or otherwise through the Services, you:

• acknowledge that you are publishing that User-generated Content, and that you may be identified publicly by your User Name in association with any such User-generated Content;
• have full ownership over the intellectual property of your User-generated Content. Your profile and the materials you upload remain yours. You can remove your profile at any time by deleting your Account;
• hereby do and shall grant AskMyMob a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, fully paid, sub-licensable and transferable license to use, edit, modify, reproduce, distribute, prepare derivative works of, display, perform, and otherwise fully exploit the User-generated Contents in connection with the Site, the Services and AskMyMob's (and its successors and assigns') business, including without limitation for promoting and redistributing part or all of the Site (and derivative works thereof) or the Services in any media formats and through any media channels (including, without limitation, third party websites). The foregoing license grant to AskMyMob does not affect your other ownership or license rights in your User-generated Content(s), including the right to grant additional licenses to the material in your User-generated Content(s), unless otherwise agreed in writing;
• represent and warrant, and can demonstrate to AskMyMob's full satisfaction upon request that you (i) own or otherwise control all rights to all content in your User-generated Contents., or that the content in such User-generated Contents is in the public domain, (ii) you have full authority to act on behalf of any and all owners of any right, title or interest in and to any content in your User-generated Contents to use such content as contemplated by these Terms and Conditions and to grant the license rights set forth above, (iii) you have the permission to use the name and likeness of each identifiable individual person and to use such individual's identifying or personal information as contemplated by these Terms and Conditions; and (iv) you are authorized to grant all of the aforementioned rights to the User-generated Contents to AskMyMob and all users of the Site and Services;
• agree to pay all royalties and other amounts owed to any person or entity due to your Submission of any User-generated Contents to the Site and Services;
• represent and warrant that the use or other exploitation of such User-generated Contents by AskMyMob and use or other exploitation by users of the Site and Service as contemplated by this Agreement will not infringe or violate the rights of any third party, including without limitation any privacy rights, publicity rights, copyrights, contract rights, or any other intellectual property or proprietary rights; and
• understand that AskMyMob shall have the right to delete, edit, modify, reformat, excerpt, or translate any materials, content or information submitted by you; and that all information publicly posted or privately transmitted through the Site and Services is the sole responsibility of the person from which such content originated and that AskMyMob will not be liable for any errors or omissions in any content; and that AskMyMob cannot guarantee the identity of any other users with whom you may interact in the course of using the Service.

AskMyMob cannot guarantee the authenticity of any data which users may provide about themselves. You acknowledge that all Content accessed by you using the Site and Services is at your own risk and you will be solely responsible for any damage or loss to any party resulting therefrom.

Disclaimers and Limitation of Liability

The Site and Services are provided on an AS IS and AS AVAILABLE basis without any representation or endorsement made and without warranty of any kind whether express or implied, including but not limited to the implied warranties of satisfactory quality, fitness for a particular purpose, non-infringement, compatibility, and accuracy.

You acknowledge and agree that, the entire risk arising out of your access to and use of the Site, Services, AskMyMob content and user submissions therein remains with you. To the extent permitted by law, you do not hold AskMyMob, its owners, or any of its users liable for any incidental, special, exemplary or consequential damages or loss, including without limitation lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure, the cost of substitute products or services, death or personal injuries arising out of or in connection with the use of the Site, Services and content therein.

AskMyMob makes no warranty that the functionality of the Site and Services will be uninterrupted or error free, that defects will be corrected or that the Site and Services or the server that makes it available are free of viruses or anything else which may be harmful or destructive.

Nothing in these Terms and Conditions shall be construed so as to exclude or limit the liability of AskMyMob for death or personal injury as a result of the negligence of AskMyMob or that of its employees or agents.

Change of Uses

AskMyMob reserves the right to:

Change or remove (temporarily or permanently) the Site or any part of it without notice and you confirm that AskMyMob shall not be liable to you for any such change or removal; and

Change these Terms and Conditions at any time, and your continued use of the Site following any changes shall be deemed to be your acceptance of such change.

Links to Third Party Websites

The Site may include links to third party websites that are controlled and maintained by others. Any link to other websites is not an endorsement of such websites and you acknowledge and agree that AskMyMob are not responsible for the content or availability of any such sites.

Credit card details and Secure Information

AskMyMob will never ask for Credit Card details on the Site and request that you do not enter it on any of the forms on AskMyMob.com.

AskMyMob will never request for your secure information such as your login password or social security number. Do not respond to email that comes from a non-AskMyMob address, but claims to require your AskMyMob password.

Indemnity

You agree to indemnify and hold AskMyMob and its employees and agents harmless from and against all liabilities, legal fees, damages, losses, costs and other expenses in relation to any claims or actions brought against AskMyMob arising out of any breach by you of these Terms and Conditions or other liabilities arising out of your use of this Site.

Severance

If any of these Terms and Conditions should be determined to be invalid, illegal or unenforceable for any reason by any court of competent jurisdiction then such Term or Condition shall be severed and the remaining Terms and Conditions shall survive and remain in full force and effect and continue to be binding and enforceable.
